General Terms and Conditions (GTC)

1.1. These General Terms and Conditions (GTC) apply to all business relations between Omegaprofy (operating the application 'Omega Prime AI', hereinafter 'Provider') and its customers (hereinafter 'User'). 1.2. Our services are directed exclusively at corporate B2B clients.

2.1. Omegaprofy provides a Software-as-a-Service (SaaS) platform for AI-driven data analysis and content production. 2.2. Infrastructure Partners: The Provider utilizes high-performance, enterprise-grade global data centers for data acquisition. The Provider does not warrant that the data provided by these third-party infrastructures is error-free, complete, or updated in real-time. 2.3. AI Disclaimer: The platform utilizes generative Artificial Intelligence models. The User acknowledges that AI-generated outputs are probabilistic and may contain inaccuracies. The User is solely responsible for verifying the accuracy of AI outputs before implementation.

3.1. The Provider’s liability for damages is limited to intent and gross negligence. 3.2. For slight negligence, the Provider is liable only for breaches of material contractual obligations (cardinal obligations). In such cases, liability is limited to typical, foreseeable damages. 3.3. The Provider shall not be liable for loss of profit, loss of SEO rankings, or indirect damages resulting from the downtime of external data centers or infrastructure providers.

4.1. To maintain system-wide integrity and security, high-level administrative functions and data validation protocols are strictly centralized. 4.2. Only the Master Account (Owner) holds final authorization rights. Sub-accounts or corporate users operate under restricted permissions.

5.1. The responsibility for the intellectual property rights, copyright violations, or any legal disputes arising from AI-generated content (text, images, or code) lies entirely with the User. 5.2. Omegaprofy shall not be held liable for any third-party claims targeting the content generated by the User via the platform.

6.1. The Provider reserves the right to impose API limits, throttle bandwidth, or temporarily suspend services if the User's activity shows signs of malicious scraping, bot abuse, or excessive load that threatens platform stability.

7.1. The Provider reserves the unilateral right to suspend or terminate accounts immediately and without refund if the User generates illegal content or violates these Terms of Service.

8.1. The laws of the Federal Republic of Germany shall apply. 8.2. The place of jurisdiction for all disputes arising from this contract is Cloppenburg, Germany.
